Abschiebungen und die ihr vorausgehenden Verfahren zur Aufenthaltsbeendigung bewegen sich im Spannungsfeld des liberal-demokratischen Paradoxons zwischen nationalstaatlichen Interessen und universellen Menschenrechten. Der Beitrag untersucht diesen Gegensatz anhand von 58 zwischen 2011 und 2013 ergangenen asylrechtlichen Ausweisungsentscheidungen und der darin vorgenommenen Abwägung zwischen dem Recht auf Achtung des Privat- und Familienlebens und öffentlichen Interessen. Der Artikel zeigt, welche Ermessensspielräume sich im untersuchten Material aus diesen beiden unbestimmten Rechtsbegriffen ergeben und dass diese tendenziell zugunsten nationalstaatlicher Interessen genützt werden. Schließlich wird erläutert, wie das liberal-demokratische Spannungsverhätnis in der Praxis aufgelöst wird.
